You have two options under Section 18 of RERA: (1) Continue with the project and claim interest at SBI MCLR + 2% per annum from the date promised in the agreement to the actual possession date β€” this is paid monthly. (2) Withdraw from the project and claim full refund of all amounts paid with the same interest rate. We analyse your agreement, calculate your entitlement, and file the RERA complaint before H-RERA.
You can verify on hrera.gov.in by searching the project name or registration number. Selling or advertising an unregistered project (above 500 sq meters or 8 apartments) is illegal under RERA. If your builder is selling an unregistered project, that itself is a RERA violation you can complain about, in addition to any other grievance. We verify registration and advise you on your options before you invest.
You can file a complaint on the H-RERA portal yourself. However, builders are typically represented by experienced lawyers who know how to delay proceedings and challenge evidence. A well-argued complaint with proper documentation of delay, payment receipts, and correspondence significantly increases your chances of a favourable and speedy order. If you purchase immovable property (other than agricultural land) for β‚Ή50 lakh or more, you must deduct 1% TDS from the payment to the seller and deposit it using Form 26QB on the income tax portal.
